A very cool thing happened to me yesterday..first a rewind to january I went to Albertsons for ingredients for mojitos; so happened that I purchased the right combonations of things and spent $25. Swiped the card. I won there "super bowl" sweepstakes which amounted to $2300 worth of certificates, a portion of which I bought a Sony big screen with. very cool! In November I went to buy lunch meat, there was a very long line, so I started mulling around and found a brochure with coupons for columbus meat products....which had the only other sweepstakes that i applied for this year. Yesterday, the Fedex truck showed up at my door. my wife recieved the envelope and handed it to me and said it appears youv'e been served.. Oh shxxt. It turned out to be a good thing I won a trip for 2 to Rome for a week.2nd Sweepstakes win, Good news. I'm excited about this trip, visiting all the points of historical interest, however I would like to pervert this opportunity into a fishing trip. I'm thinking of Faial in the Azores on the way back, and would definetly like to do something salt water in Italy.. Any Ideas? |

Paul Regarding MEXICO , this year was the first time I have ever had the skippers enforce the limits, in the east cape , I was shocked , we always try to observe the limit when fishing in there country , but they always seemed to not stop , but this year was different , maybe the FEDS are watching them. Yea the perch fishing in the winter is a great way to pass the closed season , fishing the ultra light them fish fell like a dorado , and they taste great too. GOOD LUCK with your day in court , maybe the judge will take in to consideration the HARD times and cut you some slack . When my wife and i lived aboard our boat in the delta for 14 years , the boat people were taking the short stripers and everthing else they could get a hook into ,no licences, you think the wardns were around , not a chance , I asked a warden about it he said they fish here like they are in there country and it will take some education to change there ways , if they gave them a ticket , they would not show anyway , and the dfg wont waste the manpower going after them . I hate to say it but i have put several in the drink with my wake from my 60ft vessel they would fish off pieces of foam . Oh well never saw anything about drownibng one . Blackie |

Oh yeah, Blackie we werent overlimit we had 15 or 16 for 2 Hombres. I stopped fishing on purpose... #1... We never take overlimit... I,ll BET most of you on this board (especially the older dudes) Remember the early days of Mexico. What a SIN... I did it too...Ill never forget the day In Mexico when it hit me... What over fishing really is... And for that moment what an asshole I was... Humbling... I was a young man then. I we'll never do that again... #2 We had plenty for dinner...And I dont like to clean fish... I showed my son how, and he likes doing it. He's gettin good... #3 - O. WE will be working those wiliey perch this winter...Instead of going to the Islands as I planed... Blackie I know your the perch hunter Im going to be picking your brain here soon on best locations I remember you talking about Little Pico, San Simeon area last season. Learn something new every day.... Looks like there are a bunch of restriction on what fish you can and can not fillet. Some species you simply are NOT ALLOWED to fillet (cabezon, greenlings, salmon, striped bass, sturgeon and flatfishes (except Ca. halibut). Then there are a whole group of fishes that you can fillet, but have to leave 1 square inch of skin attached. Finally, for some reason, you can fillet rockfish, but have to leave the entire skin on! News to me...fortunately I never clean fish on the ocean (glad too, for I would have definitely done it wrong). How does Patriot/Virg's get around this? Your first court visit will be to enter a plea. if your plea is innocent the they will set a new court date and the warden will be requested to show up at the next sceduled date with evidence, reports ETC. If he doesn`t show you win the case. Frickem and make them prove it. |

As far as I know, the fine is actually up to the DA and Judge. There is know set fine per fish, though 1100 bucks wouldn't surprise me. If I was you, I'd get a certified marine biologist (like the dock biologists)or Charter Boat Skipper and go to the DFG office and make the Warden pull out the fish for a second ID. The judge will default to the warden even if you're right. Remember they show up all impressive in their uniform and you're just a dirty fisherman in the judges opinion. Our local dockside checkers all seem to have issues with the wardens. All their data is protected by the Privacy Act and wardens tend to think they can push them around and get them to narc on us. Not true or they can lose their job. I watched one of them get into it with a warden who came up and asked the kid at the fillet station while he was measuring fish "who here has illegal fish" The warden got real pissed when the checker basically told him to take a flying leap. Despite that, get a second opinion other than the warden on that fish. If you can't , get a copy of the ID book the checkers have, called Guide to the Coastal Marine Fishes of California, California Fish Bulletin 157 by Bob Lea. This is the book DFG biologists use. Take this to court and request (ask real nice) for the warden to ID the fish using the key in the book. I'll bet dollars to doughnut they won't be able to use it. This might be an out for you. Paul I would show up in court , First of all if it was a canary , produce it. SECOND , did he have 11 fish or 10 , it was either a NO TAKE FISH or OVER THE LIMIT , they cant have it both ways . Steve, It seems like $1100.00 is thier new lucky number...I guess since we all bailed out the banks and the feds put up the $$$ this is thier way of recuping the money... Taking more from the people...Its criminal!!! We got the letter from the court on my sons $1100.00 canary ticket that said (rockfish overlimit???) anyway I called the court to verify and the lady I spoke to said "OH, you really should come to court because the fine Is VERY HIGH"...I presume that they will reduce it... Were going to find out... My gut says DFG starts off high balling us so when they reduce the fine to say $500 we feel like its a victory...His court date is 12/29 Im going too... I gots to see this robbery 1st hand... I thought the 1x1 skin patch was still the rule? I have been cleaning my fish at home. But thought I would start doing it on the water... Steve, It's real easy to leave the entire skin on. On your initial slice from gill to tail, stop short and leave skin attached right at tail fin. Flip the entire cut fillet skin side down, start at the tail and skin till you have just a 1/4-1/2" connection of skin and fillet. Cut the skin back at the tail attachment. You're left with a clean fillet that has a full size flap of skin. Flip the fish over and repeat. Where this rule comes from, I don't know. I think it was 2 years ago, maybe 3, I was on the Patriot with a group of guys that I know that do a yearly run on the party boat. We had broken down and were drifting and fishing by the green buoy and were nearly done for the day. Charlie was cleaning fish like mad. We were boarded by DFG and the lady Warden made Charlie stop doing what he was doing (leaving the 1" x 1" patch on each filet) and started giving him a shit fit for not leaving the entire skin. The supplement at the time called for a 1x1 patch so we were all a little puzzled as to WTF she was talking about. No cites were issued but she insisted that be the way they handled it from that point on. I never have looked into the regs to see what it says now. I just cut as I explained above if we're still on the water. |

Hey, this just happened to a former student...I thought all you had to do was leave a 1" patch??? So my brother was out spearfishing about a month ago and it was almost dark. DFG was sitting up by cayucos watching him. DFG followed him all the way to the rock and then followed him all the way to the back marina. Come on the boat and searched him. My brother wasnt trying to hide anything. but my since it was almost dark my brother and his buddies all filleted their fish. (not know you had to leave the WHOLE skin on) they left a inch by inch patch. Fish and game wrote all of them seperate tickets! So he just got it in the mail today and it was $1,110!! Thats insane right? Honestly I thought too that you just had to have a 1 inch by 1 inch patch of skin on. but the DFG warden said it was suppose to be the ENTIRE skin. why would you even fillet yourfish if you had to leave the entire skin on? I was just seeing if you think that any way possible that there would be a way to fight it? At least to lower the ticket. Thats a lot of money. He was just gonna pay it until he found out it was that much. He was to try and get it lowered but he isnt for sure if its even worth it. |

Oh my, the perch were off the hook yesterday between 2 and 4 here....draining outgoing tide, the slough mouth was bulldozed open and the sandbar and an upcoast eddy formed a wicked hole the size of two basketball courts that trapped all sorts of little bait fish....that, and the slough was draining (looked like a white water rapid pouring into the sea) tonnage of terrestrial and funky foodstuffs right into that hole...barred surf perch, calico surf perch, and franken-sized walleyes were chasing bait everywhere, perfect little foamers al over the hole...lots of fish over 10 inches, and they hit hard and were as aggressive as I've ever seen...caught tons of fish and had a blast... |

Stacey and Harrell, I just looked through my log book at last year's bonito trips. We caught over 150 fish, and they were all in 55.0-57.3 degree water. I keep track of all the details every time... it helps in times like this. |

Dave's right about the feds. They count the fish landed and extrapolate that over the number of boats not checked. The Quota is so low that just a few multiplied by the number of total boats can shut the season down and further restrict next year. So the "No retention" laws actually help us to keep fishing. If we were allowed to keep say one per boat, then they would get counted but wasting them as we do is the same as not catching them. Until some bozo keeps one. |

Besides a canary having a smooth lower jaw rather than a vermillion's rough lower jaw, check out the difference in the butt (the site won't let me type the "an.." word) fins of the two fish. The bottom of the vermillion's fin is fairly rounded, while the bottom of the canary's fin has a rearward-facing point that extends further than the upper lobe of the fin. You, too, can learn more interesting fish facts and wow your friends, make money in bar bets, and generally stay out of trouble with the DFG...pick up a couple of copies of Milton Love's (yes, he tends to be controversial but you must admit he knows his fish id's) "Probably More Than You Wanted To Know About The Fishes Of The Pacific Coast", published by Really Big Press in Santa Barbara. Keep one copy on your boat and another in your bathroom, next to your reading glasses (for all of us over 50, or even 40). You'll learn a great deal. On another note....the perchies have definitely broken out of their summer doldrums down here, in terms of size and numbers. Couple of nights ago I hit Goleta Beach right as the sun disappeared, made 25 casts, landed 20, and was bit on every cast. The two previous evenings were pretty much the same. Biggest BSP went thirteen inches. All on carolina rigged crack. Going to go again this evening before the Patriots-Saints game. |

here's my opinion on the whole canary thing. it may rub a few raw, my opinions usually do...... if you know your rockfish, there is no way in heck that you could confuse a canary with any other fish....if you don't know your rockfish or not at least fishing with somebody that does know thier fish, then you have no business on the water with a fishing pole. maybe it's time to make people pass a mandatory canary test at the dfg before issued a license? that's a joke. but the point is , the feds are breathing down our neck on this canary issue and are counting every fish...there are too many families affected for me to have much compassion for anyone that gets a fine for keeping a canary. there are plenty of fish id charts out there that can be downloaded for free. |

Thinking about purchasing a few crab pots to drop at PSL. Is there a crab season? Any restrictions on crap trap size or openings in CA? Looking at 34" traps with 3 4" opening doors? Any suggestions? Thanks |

Regarding fish releases... I have an SFD (Shelton Fish Descender) in my hands right now. I have a buddy that I duck hunt with that is on the Mendocino County F&G Commission. The commission put together a FREE educational packet directed to fisherman that included an SFD with instructions for it's use. He sent me one a couple weeks ago to sample. They're $6 if you buy direct at the link below. I'm going to discuss with my buddy how they got the program started. SLO County has a F&G Fines Committee that determines where this County's portion of DFG related fines are spent. Seems to me a very worthy cause for a potentially small amount to administer. Stacey, There have been some bonito down in the channel. Buddy of mine went out on the Stardust in SB on mon. 11/23 and they trolled for bonito for 2 hrs. The boat only caught three but there must be some fish there for them to spend that much time and effort on a short trip. On 11/16 while on our trip to Rosa we saw a bunch of birds working in the mornning but we didn't investigate because we were after rockfish. So I would think that there could be fish there. If not trailer down and try SB. The fish that were caught on the Stardust were about 8 lb. |

I rarely release more than two fish per trip. Mostly too-small fish. I've never caught a canary on my trips, but must say I don't get to go that often. I've caught a lot of short lings that can swim down on their own,(no swim bladder). These rigs are so simple to make that there is no reason to purchase a store bought one. See John Moores post, pdf version, page 4, method B or C. Mine is more like method C, but am going to make a method B, and epoxy the upper swivel to the start of the bend in the hook. Tim, I think you may be right. I guess I would probably somehow enjoy the martyrdom of myself or someone here being ticketed for an obvious to anyone "release rig", It would make W.O.N., local papers,drudge report,every fish website, the governors desk and most of us would would show up in court if at all possible. even Packards would take your side. The canary ID issue is more complex. Any warden that went down that road would get assigned to monitoring and surveying old Fish carcasses in black dumpsters in july and reporting in detail to the boss. Or sea lion turd survey to see where rockfish really go? So the bucket of rocks will stay home for now and not be refilled. Unless we get tired of winding up from the pre benthic 240ft depths too often. Now you only have to worry about releasing a real small one and being accused of fihing with live bait? Now JIm B, Dont be a smart aleck and put a peice of squid on our release rig when the wardens come by. :-) maybe they will give is a set of various weight release sinkers free with our overprice licenses? I wont wait for that one. |

B.A.; When I was checked at sea on the final day by DFG, they were actually impressed with my fish release - rod set-up. You can tell it's not for catching fish. It has a large, dulled, barbless hook, and a weight. It might have been the reason they gave us a warning on another matter? Don't ask me what that was. Tim |

Doesn't look like anyone here will be purchasing the $5 tag to help support our game wardens when you purchase your fishing license. What a joke, they already f us in every which way. How about giving us a $5 discount tag for dealing with all their f up ways. I think they should hit up the govenators extra 10% tax on our checks instead of asking for more from us. |

After I finished sand dabbing on Wednesday I took the boat down to Port San Luis. Just north of the Pea Patch we saw a bunch of birds on the water just like last year when the bonito were in. I didn't have time to fish the area for bonito but might be worth a look. Bob |

Im not an attorney , BUT I think if they busted me for a look a like fish , they would have to have that fish in court for evidenace,other wise they have NO proof that you took that fish . In my younger days a bunch of my buds and I were on a ab trip up north , for the weekend , when we came up the cliff after two days we were surrounded by wardens with weapons drawn, they had us dump all our gear , and they proceeded to measure and count our limits , was 6 a day then. They came up with ONE ab that was 1/2 short , there were 6 of us diving for two days , well I guess they had us . they gave us the option of tickets for all or one guy take it , we drew straws , my buddy AL got the short one , they punched some holes in the shell and tagged it for evidence if front of us , when AL went to court the AB was there with the warden , it cost each one of us a 100 bill , because no one new who took the short one , the only fair way . That may not be the way the dfg operates now , dont know , but I still feel that if there aint no body , there aint no proof. My sunday morn 2 cents worth . PS tried the perch yesterday , no luck ocean to nasty . Blackie |

harrell and others, I didn't keep any records from last year's bonito bite as far as water color and temp goes. I do remember the water coming from the south. Now I see there is a plume of water coming up from pt conception. What are your thoughts? |

Yeah...been there with the Canary thing...told the warden " thats not a canary" your as confused as a termite in a yo yo...and he says "are you getting smart with me? I replied " how would you know?" Anyway....even the bald judge was grumpy so I told him at least you don't have to worry about a bad hair day....geese! the whole thing cost me a fortune.. |

John , my bucket of rocks is cheaper and easier than their disposable gaff, same idea, their is just fancier and wastes good rebar, im afraid of using a fish descender on my line as a warden could easily accuse you of using too many hooks. with the local enforcement reputation I would want that one in the code before employing. maybe they shoudl allow one more hook , a big barbless one? |

Good info on releasing fish Tim. I hate the idea of having to throw a no take fish back only to have it float off and die. This is a link to some info on properly releasing rockfish. I will let someone else bring up the 40 oz model from 240 feet. On the small one, ill let them down, Jim B, you can wind up that empty 20 oz er after the release. maybe you can let them down to 50feet or so instead of all the way. How small can you go to submerge a gopher ? a Canary? etc. |

We should to keep a bucket of rocks with paper clip halves wired to them or tied with string. put one on the fish ,the fish can get away easy after they submerge. then you dont easily get accused of having a second rod in or too many hooks. wardens have us paranoid. But now are we afraid some warden can,t tell a vermillion from a box of rocks? not yet I hope. I always thought "canaries" got their name from the canary yellow color most should have, I.E. if its really orange or red its not a canary but a red copper or a vermillion or one of those 50 semi rare rockcod varieties that you run across from time to time. Now im the idiot massaging fish chins, holding them up to the foggy sky to see the latteral lines opacity,looking for rare sometimes present features and releasing them anyway. wait till they chage the rules again, the wardens will be as confuses as the citizen, license sales will fall further and the seals&lions will eventually starve en-mass after they have depleated the nearshore waters. |

paul, myself and two of my good friends were cited about 3 years ago on may 1st for having in possession "canary" rockfish. the fish were actually copper rockfish aka chucklheads. I am 100 percent sure of this but i did not have a camera with me and the fish were confiscated, aka eaten by the fat warden. I also could not go to court because i was outside the area fighting a wildfire. Since then i have had a warden try to cite me for an orangish colored vermilion but i pointed out the fact that it had a rough chin and after he got a second opinion he apologized, i told him i wouldn't care if he could get me and my two friends our 330 dollars back. now its 1000 bucks, i guess the state doesnt know we are in a recession not experiencing inflation in our current economical state. I would pay 50 dollars for a seal tag and 100 dollars for a sea lion tag, if they want a way to increase revenue. |

The way I learned it...You have to show intent before you have broken any law...We didnt Intend to to break any laws or take any protected fish...Ive been hunting and fishing with my sons all thier lives...And we all abide by the rules...Thanks alot guys... Sand dab report: We fished off the Rock in 180-200 feet of water for 32 dabs in 1 1/2 hrs for two of us. I suggest a 8-10 size hook. We also use two weights, one at the top of the rig and one at the bottom. Bait like squid will help. Now after you cut the head off, roll them in bread crums and let them sit for 15-20 min so the crums will stick to the fish. Fry in a butter and oil mix to golden brown. While the fish are cooking, you can make a lemon caper sause by squeezing one or two lemons into a sause pan with a table spoon of capers. Add a 1/3 cube of butter, a dash of sugar and just a dash of corn starch. Heat to a semi boil and drizzle on your sand dabs. Can't beat them. Remember Monday at 6:00 pm KVEC 920 am for one hour of discussion of sport fishing issues. Bob |

Heres the Happy Thanksgiving Fishing Story I didnt tell... Last day of season on our way to PSL for fishn & BBQ. Just my son and myself. Our other crew bailed...The ramp before PSL I have to get off... got a flat on trailer... WE just wanted to fish...I baby'd that thing to port...Didnt put In until 9-9:30 Got up by Pecho, from the 1st drop we were on... Nic hooks up with what seamed like a big ling got a straightened hook back... Then blacks an blues BIG ones, with shoulders...We even thru back fish. Ended up keeping 15 all nice fish and one beautiful copper...Back at port 11:30 for BBQ & BEERS...Great DAY...Marty thanks for taking care of me... I told my Son what that ticket cost last night...He said Dad I dont care about that ticket we Killed EM!!... |

DRAGON I know its not going to make you feel any better , BUT some of the new wardens just dont know there fish , I have had two instances where I gave then a lesson, one simular to yours red vers canary , the warden s came aboard our boat to check our limits , he found a fish he swore was a canary , he rode back to the dock with us , where we met his partner , I showed him the differance all the way in , but he was having none of it , he had a good bust , well his buddy looked at the fish and said , ITS A RED, and we were off the HOOK . Another time i was surf fishing in CAMBRIA and a warden checked my bag , he found what he said were RED TAIL PERCH , I kinda laughed and said no they dont live here , these are CALICO , I then procedded to show him the 8x10 color glossy photos with description and arrows , he finally left me alone . CANARY VERS VERMILLION And the CHIN ON THE TWO fish is the best way if its smooth let it cruise. HAPPY AND BLESSED THANKSGIVING TO ALL. Blackie |

Paul - That just makes me smoke. I'm really sorry that happened to you. You're not alone. It's not like the fish is endangered. It's listed as "overfished" (but it's not) and in a rebuilding status. We all can petition the commission to reduce the fines on this to a reasonable amount. The commission is supposed to oversee the DFG and regulate them. If everyone writes in their experiences with this issue, it can be changed. It just takes time and organization. There was a time where we all regulated each other. But when you have this kind of obscene penalties for an honest mistake (and that's extreme even if it was intentional) it creates an us against them mentality. ie - I haven't called Caltip in many, many years. But they want enforcement officers. |

I havent read all your great advise yet... But I will tell you Im going with my son on this one...We have the chart with all the pictures and the 2 very distint pointed out features on the card said white lateral and white belly... There was no black edges on the fins anywhere. Anyway there better be the warden with a fish to show... Ill keep ya posted...Thieving Pricks... Im not talking about the wardens as much as the system...ITS BROKEN...And the EnvrioKooKs bought and paid for it...Ill probably have to go into the sealion thing too... 26 yr. old barely working carpenter...That fine amount is shamefull...Just screams happy holiudays,,,Huh...Im going to help him out on this one...Ya All have a Happy Thanksgiving... |

When they first put the canaries on the no catch list we brought in a smaller one that looked just like a red. My friend and I still swear that the other caught it to this day. But I signed the ticket, wrote the judge a letter explaning our position and he was very gracious to reduce the fine. I would have shown up for the court date but it would have cost me quite a bit more to miss work. The pictures I sent with the letter were very helpful in explaining how we could have misidentified it. It was sent registered mail, things get lost easily in a court system. I am like several of the other posts in that if I don't know the fish it goes back in and at the end of the day I take a good look at them all. Hope things go well for you. |
